MEDIATION

An out-of-court settlement is in many cases time-saving and extremely useful. Moreover, you do not run the risk of not reaching an agreement in court or even allowing the other party to make a legal decision. To reduce your risks in the best possible way, we will be happy to assist you in mediation at any time. Here at Swiss Law, we work with you to develop a suitable strategy and help you find a fair solution in every area.

The Mediation Process

Corporate Mediation

Good to know

As soon as the parties involved have agreed to mediation, we as mediator open the preparatory negotiations. For this purpose, we first summarize the characteristics, functions and the course of the session and discuss it in advance.

To reach agreement on a common basis, the topics of the negotiation are first discussed. In this way, misunderstandings are avoided and information gaps are closed. During the stocktaking process, a common understanding is thus created.

In the function of mediator, we then go in search of the interests of both parties and try to reach an appropriate agreement. In this way, a uniform basis can be developed to meet all needs.

In the fourth phase, all those involved bring together what they consider to be suitable solutions. Within the Brain Storming, all conceivable ideas are collected to select the appropriate options. In this way you profit from maximum benefit.

Once all ideas have been discussed and evaluated, we can decide together with you on the most suitable solutions. These will of course be notarised and provide a binding legal basis – without the need for the time-consuming process in court.
